Labour Court recommends alternative work for dismissed Limerick Corporation pool supervisor

By Cathal Brosnan

Historic decision · Decision date:

Place: no local area assigned from the source.

The Labour Court recommended that Limerick Corporation offer a dismissed swimming-pool supervisor a job in the pool area as close as possible to his former position, and treat the time since his dismissal as suspension. The recommendation was dated 27 March 1991. The Services Industrial Professional Technical Union claimed the worker had been unfairly dismissed and should be reinstated. The worker said he had permission to give swimming lessons and complied with a later instruction to stop lessons for schools. Limerick Corporation said he had ignored instructions, given paid lessons while on duty and put pool users at risk while acting as the only lifeguard. The Court was less than convinced the Corporation had been unaware that teaching and coaching were taking place.
