Labour Court leaves arbitrator award in place in M.V. Teutonia dispute

The Labour Court left an arbitrator's award in place in a dispute between Dublin Cargo Handling Limited and Marine Port And General Workers' Union over finishing time aboard the M.V. Teutonia. The union said dockers worked after 10pm and were entitled to double time; the company relied on records showing a 10pm finish. The arbitrator had proposed an ex-gratia payment of one hour's basic pay after being unable to establish the exact finishing time. The Court found that this did not amount to a fundamental breach of the agreement and declined to set the award aside. It made no recommendation on the separate washing-up-time issue because the arbitrator had not decided it. The decision was signed on 9 March 1988.
