In 1987, the Labour Court found there was no redundancy in the case of an Advance Tyre Company Limited worker who retired early on health grounds. It did not recommend conceding the Irish Transport and General Workers' Union's claim for an £11,880 ex-gratia payment. The recommendation was signed on 22 January 1987. The union compared the claim with payments made to other managers who had retired. Advance Tyre argued that those cases involved redundancy, while this worker's employment ended because of incapacity. The worker received a pension and a lump sum under the company's pension scheme.
