In 1986, the Labour Court recommended against the Irish Transport and General Workers’ Union’s claim that Texaco (Ireland) Limited breached its agreement by refusing to process a supervisor’s dismissal through the grievance procedure. The recommendation was signed on 20 October 1986. The union argued that the dismissal could be challenged through the agreed procedure and that the supervisor should have remained on paid suspension while it ran. Texaco said it had summarily dismissed him after an investigation and that a dismissal challenge belonged before the Employment Appeals Tribunal. The Court interpreted summary dismissal under the agreement as dismissal without the usual formalities. It disagreed that Texaco had breached the agreement and did not recommend conceding the union’s claim.
