WRC recommends recognising worker’s five years of public body service

The Workplace Relations Commission recommended that a public body recognise a worker as its employee from June 1989 to September 1994 and correct her employment records within four weeks. The recommendation was dated 16 July 2026.

SIPTU brought the dispute on the worker’s behalf. She said the public body interviewed and directed her, authorised her leave and oversaw her work at its site, while a separate company paid her. The public body disputed that she was its employee during those years and argued that the WRC could not make a legally binding ruling on employment status.

The adjudicator found that the public body had hired the worker and seconded her to the separate company under an undocumented arrangement. The WRC recommended recognising her service and correcting her records. The recommendation included no monetary compensation.
