The WRC found that a psychiatric nurse had suffered no detriment arising from reporting an injury and his subsequent absence from work, and recommended that he follow union advice and raise a grievance on his return. The recommendation, dated 3 July 2025, also said the employer should take no further action unless a grievance was submitted.
The nurse’s dispute concerned refusal of leave under the employer’s Serious Physical Assault Scheme. He said he faced harassment and penalisation, while the WRC found he remained employed and had not been dismissed or demoted. The officer said the nurse had not used the available grievance process, leaving no outcome for the WRC to review.
The WRC recommended that the nurse follow advice from the Psychiatric Nurses Association and engage with the employer about his grievance when he returned to work. It recommended no further action by the employer in the absence of a grievance.
