WRC finds worker’s dispute not well founded after unfinished grievance process

The WRC found a worker’s dispute not well founded because she referred it before exhausting her employer’s internal grievance procedures. Adjudication Officer Christina Ryan dated the recommendation 31 January 2024 and did not recommend in the worker’s favour. The worker, a BIM/3D modeller, said she had engaged with the employer’s investigation after referring the dispute and believed the procedures were complete. The employer said its investigation was still underway. Ryan found the worker had not provided comments on the draft report and the employer was awaiting her response before completing the investigation. She concluded she could not intervene in the unfinished process.
