WRC says discrimination claim falls outside industrial relations dispute

The Workplace Relations Commission did not recommend in a worker’s favour in an industrial relations dispute repeating her discrimination claim. The recommendation was dated 31 January 2024. The adjudication officer found the discrimination complaint did not fall within the definition of a trade dispute under section 13 of the Industrial Relations Act 1969; the merits were not decided. The office administrator alleged discrimination because of her religion and race and said she was dismissed for discriminatory reasons. The employer said her employment ended during probation for performance reasons and with notice. The officer noted that the worker had referred the same discrimination claim separately under the Employment Equality Acts and had not referred a dispute about the fairness of the termination procedure.
