The WRC recommended €45,000 compensation and a separate €50,000 back payment for a Finance Worker after a five-year assignment in a more senior role ended.
In a recommendation dated 18 February 2025 under the Industrial Relations Act 1969, the adjudication officer said the voluntary trade dispute process could not establish a legal right to enhanced pension benefits or backpay. The recommended payments addressed the effects of not appointing the worker permanently and the subsequent drop in earnings.
The worker sought pension rights and salary reflecting the higher role. Health Service Group said the pension scheme did not permit the requested enhancement and cited exceptional reasons for the temporary assignment’s length. If accepted, the recommendations would be in full and final settlement; the back payment would be treated as pensionable earnings for the relevant year.
