The Workplace Relations Commission recommended that Health Service Provider pay Staff Nurse 2 €10,000 for distress caused by shortcomings in its handling of a complaint against her. Adjudication Officer Ewa Sobanska dated the recommendation 13 November 2023.

Staff Nurse 2, represented by the INMO, said the employer failed to follow its Trust in Care procedures and delayed investigating the allegations. The employer said it had followed the policy and cited factors including the COVID-19 pandemic and staffing changes.

The National Investigations Unit did not uphold the allegations against the workers. Its report identified delays, shortcomings in preliminary screening, no evidence that support services were available, and a failure to give Staff Nurse 2 a copy of the complaint. The WRC recommended that the employer honour the investigation’s findings and pay €10,000 in full and final settlement.
