The Workplace Relations Commission ordered Klubert Trading Limited.T/A Daly's Supervalu Greystones to pay Sebastian Calugar €1,500 after finding he was discriminated against on the ground of gender. The decision was dated 14 November 2023.
Calugar said a store manager refused to serve him because he was not wearing a mask, while his wife, also without a mask, was allowed to shop. He argued that stress and anxiety made him unable to wear one and that the store should have accommodated him. The WRC found the evidence did not establish that he had a disability at the time, so his disability and reasonable accommodation complaint failed.
The Commission upheld his separate gender complaint, finding that the respondent had not rebutted the inference of discrimination. It ordered compensation for the effects of that discrimination. The respondent did not attend the hearing.
