The Labour Court dismissed Siobhan Mcnally’s appeal on 7 May 2025, upholding the WRC decision that it had no jurisdiction to hear her complaint under the Safety, Health and Welfare at Work Act 2005 because it was lodged out of time. Rotunda Hospital argued that McNally’s employment ended in May 2019 and the complaint was late. McNally said monthly payments showed the employment relationship continued. The Court found it ended on 20 May 2019 and said it could not consider whether the pension was authorised.
