The Labour Court varied an Adjudication Officer’s decision on a fixed-term work complaint by Mr Sean Reilly against the Minister For Enterprise Trade and Employment. The Court found it had no jurisdiction to consider the complaint, so the merits were not decided.
In a decision dated 24 May 2024, the Court said Reilly’s contractual arrangement had ended no later than 3 July 2018. The statutory period for his complaint ran from 27 August 2018 to 26 February 2019, after the arrangement had ended.
Reilly alleged that the Minister failed to give written reasons for renewing his fixed-term contract. He argued that the arrangement ended when his warrant was revoked on 25 October 2018. The Minister’s position was that the arrangement had ended before the statutory period. The Court concluded that it had ended no later than 3 July 2018, so it could not consider whether the alleged failure breached the law. The Adjudication Officer had not upheld the complaint; the Labour Court varied that decision accordingly.
