Labour Court disallows Liam Ryan’s out-of-time penalisation appeal

The Labour Court disallowed Liam Ryan’s appeal against a Rights Commissioner decision, finding his penalisation complaint was brought outside the time limit. The determination was dated 17 December 2014. Ryan said North Tipperary County Council penalised him by placing him 33rd on a temporary work panel, preventing him from securing a contract of indefinite duration. The Court found the claim accrued, at the latest, when he received his ranking in February 2012, while he referred it in October 2013. It affirmed the Rights Commissioner’s decision that the claim was statute-barred; the merits were not decided.
