The Labour Court rejected Dr Abdul Monem Janjua’s appeal against a time-limit ruling in his case against Peamount Hospital. The determination was dated 4 December 2009; his substantive claims were not heard. Dr Janjua, a non-consultant hospital doctor, claimed entitlement to a contract of indefinite duration, victimisation on dismissal and less favourable treatment than a comparable permanent employee. The Court found that his first two claims were lodged two days outside the six-month time limit and that negotiations did not justify an extension. It found that the Section 6 claim was first raised at the Rights Commissioner hearing and had not been properly submitted in writing. The merits were not decided.
