The Labour Court found that Tara Carroll was dismissed because she was pregnant and awarded her €6,000 compensation. The determination was dated 17 December 2002.
Carroll worked as a chef’s assistant at the Ivy Inn in Naas. Paul Cullen denied dismissing her and said her job remained open after her maternity leave. The Court cited his issuing of a P45, failure to reassure Carroll that her position was secure and lack of a reasonable explanation for refusing to sign her maternity benefit form.
The Court found no exceptional circumstances unconnected with pregnancy that could justify the dismissal, and awarded Carroll €6,000.
