Edward Bourke loses disability discrimination appeal against Kilkenny County Council

The Labour Court rejected Edward Bourke’s appeal against Kilkenny County Council, finding no disability discrimination, failure to provide reasonable accommodation or victimisation. Its determination was signed on 16 January 2026. Bourke alleged that the Council offered unsuitable redeployment roles and placed conditions on his return to work. The Council denied discrimination and said it engaged with him and his union about redeployment and support. The Court accepted that Bourke had depression but found the Council was not on notice of it during the relevant period. No award was recorded.
