The Labour Court has upheld the dismissal of Bahman Honari’s age and race discrimination complaint against the HSE Healthcare Pricing Office, after finding it was brought outside the statutory time limit. The determination was dated 6 January 2025. Honari had applied for a Grade VIII Statistician position and was unsuccessful at interview on 5 July 2022. He argued that the last alleged act was the rejection of his formal appeal and sought an extension, saying he had miscalculated the deadline and allowed the respondent time to make amends. The respondent disputed the discrimination allegation and said the complaint was out of time. The Court found his explanations did not justify extending the deadline and that the complaint was filed too late. The appeal was not allowed and the adjudication officer’s decision was upheld. The merits of the discrimination complaint were not decided.
