Labour Court upholds time-limit ruling in Rotunda Hospital equality appeal

The Labour Court upheld the dismissal of Ms Siobhan Mcnally’s employment equality complaint against Rotunda Hospital, finding it was outside the statutory time limit. The determination was dated 11 April 2024. The Court could not proceed to hear the substantive complaint, so the merits were not decided. McNally argued that alleged misrepresentations in earlier proceedings affected when the time limit began. The hospital denied making a relevant misrepresentation. The Court found none had been established, so the provision that could extend the time limit did not apply.
