The Labour Court upheld the decision rejecting Colman Curran’s disability discrimination complaint against Magna International Autolaunch Ireland Limited. In a determination dated 27 November 2023, the Court found the company had not discriminated against him after a workplace injury.
Curran said the company threatened disciplinary action, withheld pay, delayed his social welfare application and denied him reasonable accommodation after he was injured at work. The company denied discrimination and said he had not shown less favourable treatment than other workers.
The Court found Curran had a temporary disability arising from a cartilage injury to his nose. It concluded that the employer’s treatment followed the workplace incident rather than his disability. The Court also found that Curran was not certified fit to return to work and had not sought accommodation to help him do so. His appeal failed, and the original decision was upheld.
