The Labour Court found that Ms Ciara Farrell had a contract of employment with Newgrange Energy Limited, trading as Green Electric, for the purposes of her disability discrimination claim. The Court remitted the claim to the Workplace Relations Commission for adjudication. Its determination was signed on 26 April 2023.
Ms Farrell alleged disability discrimination and a failure to provide reasonable accommodation. The respondents said she was employed by Robert Lynch Heating; she said she worked for Green Electric under Ian Lawlor. The Court found the facts consistent with an agreement for her to perform work personally for Newgrange Energy Limited trading as Green Electric. Under the Employment Equality Act, the definition of a contract of employment is broad. The Court concluded she had such a contract for the period relevant to her claim. It did not decide whether discrimination occurred; that claim remains for the WRC to adjudicate.
