The Labour Court dismissed Frank Madigan’s appeal against the decision that his age discrimination complaint against the Public Appointments Service was out of time. The determination was dated 7 October 2022. The merits were not decided. Madigan said a recruitment presentation assessment board discriminated against him by not placing him on an appointment panel. He was told on 30 August 2019 that he had not been placed on the panel, and the WRC received his complaint on 30 November 2020. The Labour Court found it was presented more than 12 months after the alleged act. The law provided for a six-month time limit, extendable for reasonable cause to no more than 12 months, so the complaint could not be brought into time.
