The Labour Court found Brian Dunne’s appeal in Christopher Clifford’s employment equality case was outside the time limit and that it had no jurisdiction to hear it. The determination was dated 23 November 2020; the merits were not decided on appeal, leaving the Adjudication Officer’s €10,000 award undisturbed.
The Adjudication Officer had found that Clifford was discriminatorily dismissed by his former employer, Dunne, and awarded €10,000. Dunne argued that different issue dates for related decisions caused confusion about the appeal deadline. Clifford opposed an extension. The Court found Dunne had not shown that exceptional circumstances prevented a timely appeal.
