The Labour Court rejected Denis Moore’s disability discrimination appeal against The Governor and the Company of the Bank of Ireland, upholding the Adjudication Officer’s decision in a determination dated 19 November 2019. Moore challenged an alleged requirement to retire at 60 and the handling of his request to return to full-time work. The Court found the bank had not required him to retire at 60; the only reference to that age was in a settlement offer he did not accept. It also found his medical advisers had certified him unfit to return during the relevant period, while the bank had offered more than one return date. The Court concluded he had not established facts from which disability discrimination could be inferred.
