The Labour Court overturned a €12,500 award to Glenn Sheppard after allowing Jewel Star Designs Ltd’s appeal against a finding of age discrimination and discriminatory dismissal. The determination was signed on 13 May 2019. The Adjudication Officer had upheld his complaint and awarded compensation.
Glenn Sheppard said a company director told him he was too old for the job shortly before dismissing him. The company said it dismissed him because of his behaviour and denied that age was a factor. The Court found he had not established facts from which age discrimination could be presumed. It concluded that he was not discriminatorily dismissed on age grounds and overturned the Adjudication Officer’s decision.
