The Labour Court rejected Ruth Duane’s appeal against an Adjudication Officer’s decision in her disability discrimination case against Happy Feet Peter Foley T/A Happy Feet, affirming the original decision. The determination was signed on 14 March 2017. Duane alleged discrimination in her dismissal and a failure to provide reasonable accommodation. The Court found that the text messages did not refer to a disability and that she had not established that she notified Foley or his manager of a disability after she was declared fit to return to work on 1 February 2015. It concluded she had not established facts from which discrimination could be presumed.
