The Labour Court dismissed Vladislavs Persenkovs’ race discrimination appeal against Grieve Construction Limited, finding that the evidence did not establish discrimination. In a determination dated 27 September 2010, it also dismissed co-appellant Nikolajs Nemnasevs’ appeal after he did not attend the hearing; the merits of his appeal were not decided. Persenkovs challenged findings concerning his working conditions, training, harassment and dismissal. The Court said he had not produced enough evidence to infer that his treatment was linked to race or nationality, and his appeal failed. Nemnasevs also appealed an Equality Officer decision, but the Court dismissed his appeal after he did not attend and upheld that decision in his case.
