The Labour Court upheld a finding that Michael White was not discriminated against on disability grounds after he failed to get a place on Fermoy Image Avondhu Tourism’s social employment scheme. The determination was dated 16 June 2009, after White appealed the Equality Tribunal decision. The Court treated a letter sent to White in September 2006 as a possible final refusal, allowing his complaint to proceed. It found no evidence linking his failure to get a placement to his disability. The Court accepted the scheme supervisor’s account that White had limited the work he would do and that other placements were available. White said he was willing to do any available work.
