Labour Court sets aside Joe Adams holiday-pay finding on John Sisk appeal

The Labour Court allowed John Sisk & Sons Limited’s appeal and set aside the Rights Commissioner’s decision that Joe Adams was entitled to holiday pay calculated with travelling-time payments. The determination, dated 20 October 1999, found the complaint not well founded. SIPTU argued that travelling time was part of normal weekly pay and should count from April 1997; the company said it covered employment-related travel expenses. The Court found the governing agreements classified the payments as expenses, not pay. The determination did not affect the industry agreement providing for their inclusion in holiday pay from 1 September 1999.
