Labour Court sets aside William Heslin holiday-pay finding on Pierse appeal

The Labour Court allowed Pierse Contracting Limited’s appeal and set aside the Rights Commissioner’s decision on William Heslin’s holiday-pay complaint. The determination, dated 20 October 1999, found the complaint not well founded. SIPTU argued that travelling-time payments formed part of Heslin’s normal weekly pay and should count from April 1997. The company said they covered employment-related expenses. The Court found the governing agreements classified the payments as expenses, not pay. A separate industry agreement provided for including them in holiday pay from 1 September 1999; the determination did not affect that agreement’s full implementation.
