The Labour Court allowed John Paul Construction Limited’s appeal and set aside a Rights Commissioner’s decision that travelling-time payments should count towards Christopher Andrews’s holiday pay. The Court dated its determination 20 October 1999. SIPTU argued that the payments formed part of Andrews’s normal weekly pay and sought to have their inclusion backdated to April 1997. The company said they reimbursed employment expenses. The Court found they were expenses, not pay, and held the complaint was not well founded. An industry agreement had provided for inclusion from 1 September 1999.
