The Labour Court allowed an appeal by Ta Hotels Limited T/A Lynams Hotel and set aside an Adjudication Officer’s decision in a case brought by Vireshwarsingh Khoosye. The determination was signed on 4 December 2019.
The officer had found Khoosye’s complaints under the Organisation of Working Time Act 1997 well founded and directed the hotel to pay €1,700 for annual leave entitlements on cesser of employment, €70 for Sunday premium and €1,000 compensation for breaches of the Act.
The Labour Court found that the employment contract relied on for the claims was tainted with illegality and unenforceable in law, so Khoosye could not maintain the claims under the Act.
