The Labour Court overturned a €1,209.16 award to Preeti Khoosye after allowing an appeal by her former employer, Ta Hotels Limited T/A Lynams Hotel. The Court’s determination was dated 4 December 2019.
An adjudication officer had found Khoosye’s complaints under the Organisation of Working Time Act 1997 well founded and directed the hotel to pay €1,209.16 for annual leave due when her employment ended, €50 for Sunday premium and €1,000 compensation for breaches of the Act.
The Labour Court found that the employment contract relied on for the claims was tainted with illegality and unenforceable in law. It allowed the hotel’s appeal and set aside the adjudication officer’s decision.
