The Labour Court awarded Ana Lacramioara Manciu €20,000 compensation after finding Stablefield Limited consciously breached her working-time rights. In a decision dated 18 October 2019, it set aside the Adjudication Officer’s decision and also awarded Manciu €333.32 for four days’ annual leave, €1,000 compensation for the leave breach and €88.84 in unpaid public-holiday pay.
Manciu said she regularly worked about 80 hours a week as a harvest manager. Stablefield disputed this and relied on pay records. The Court found those records did not meet the required standard and the company had not rebutted her evidence. It concluded that a week of at least 80 hours was the regular reality, exceeding the 48-hour limit. The Court also found Manciu worked six days a week and was owed four additional days of annual leave. The parties agreed she had been paid for five public holidays at 6.23 hours rather than 13 hours each.
