The Labour Court recommended that a worker offered six months’ arrears and future on-call payments must join the roster to qualify. The recommendation was dated 16 October 2019. The worker, represented by Connect Trade Union, appealed an earlier recommendation for renewed discussions with the Health Service Executive after his on-call allowance was stopped. The union said roster participation was voluntary and sought reinstatement; the employer said he had chosen not to join. The Court noted that the agreement made roster membership a condition of the allowance. It gave the worker one month to say whether he would join. If he did, he should receive six months’ arrears and the allowance going forward; otherwise he would not qualify for either.
