The Labour Court overturned a Rights Commissioner’s recommendation that a worker at the Office of Tobacco Control could not bring an incremental-credit claim. The decision was signed on 27 September 2010. The Association of Higher Civil & Public Servants appealed on the worker’s behalf. The underlying dispute concerns the incremental point assigned when she was promoted to the Assistant Principal scale. The Court found she was employed by the Office, an independent State agency, and had the right to have her claim heard. The claim’s merits were not decided in this appeal.
