The Labour Court increased Adam Barnowski’s award against MCR Personnel Limited from €2,500 to €5,000 on his appeal, in a determination signed on 15 August 2011.
The Rights Commissioner had found that the company breached the Organisation of Working Time Act 1997. Barnowski appealed the amount, and MCR Personnel Limited did not cross-appeal.
The Court said the original award did not meet the standard required for redress under European law, which must compensate for loss and deter future breaches. It varied the award to €5,000.
