Labour Court upholds rejection of clinical psychologist’s sex discrimination claim

In 1993, the Labour Court upheld an Equality Officer recommendation rejecting a clinical psychologist’s sex discrimination claim against the Western Health Board over incremental pay credits. The determination was dated 19 July 1993. The worker appealed, arguing that a male comparator received credit for university attendance while she did not. The Court accepted that the comparator’s credits resulted from incorrect Department of Health advice, not sex discrimination. It also noted that two other appointees, one male and one female, received similar credits in error. The appeal failed, and the worker was found not to have been treated less favourably on grounds of sex.
