The Labour Court rejected the Department of Defence’s appeal and upheld the Civil and Public Service Union’s appeal on behalf of a worker refused access to a promotion competition. It found that an eight-day pregnancy-related illness absence should have been discounted and that the refusal amounted to sex discrimination under the Employment Equality Act 1977. The decision was signed on 21 December 1992.
The Court upheld the Equality Officer’s recommended compensation of £1,000 and determined that it should be paid.
