The Workplace Relations Commission rejected Adrian Nilo Carbonero Gomez’s complaint that Evolve Eatery dismissed him because of his age and Spanish nationality. The decision was dated 6 March 2026. Gomez withdrew a separate minimum-notice complaint at the hearing after receiving notice. Gomez worked as a chef for about four months and said the dismissal was discriminatory. Evolve Eatery said colleagues had complained about his communication style, that he did not improve after feedback and that it failed his probation. The WRC found Gomez had not established facts supporting a presumption of discrimination. No award was recorded.
