The Workplace Relations Commission ordered Counter Products Marketing (Ireland) Limited trading as Cpm Ireland to pay Alan Daniels €12,500 after finding he was unfairly dismissed. Adjudication Officer Christina Ryan’s decision was dated 16 February 2026.
The company summarily dismissed Daniels on 20 February 2025 for alleged gross misconduct following an interaction with a member of the public while he was off duty and driving a company-branded vehicle. Daniels disputed the allegations. The company said a client complaint concerned inappropriate conduct that could harm both reputations, and maintained that dismissal was justified and fair procedures were followed.
The officer found the company had not adequately tested the third-party complaint’s reliability or consistency, the dismissal was disproportionate and the disciplinary process was procedurally flawed. She said the company had not established substantial grounds for dismissal. The award took account of Daniels’s financial loss and efforts to find work.
