WRC finds Oleksandr Svitlychnyi’s unfair dismissal complaint outside its jurisdiction

The Workplace Relations Commission found Oleksandr Svitlychnyi’s unfair dismissal complaint against Treatvale Ltd t/a The Happy Family Bakery was outside its jurisdiction and was not upheld. The decision was dated 29 July 2026; the merits were not decided. The adjudication officer found that National Minimum Wage Act rights played no part in the termination, so Svitlychnyi could not use the exception to the usual 12-month service requirement. Svitlychnyi said he was dismissed after three days without due process and was owed a day’s pay. The company said he was dismissed for poor performance. The decision made no finding that the wage rights allegation caused his dismissal.
