WRC unable to consider four TUPE complaints after wrong entity named

The Workplace Relations Commission was precluded from considering four TUPE complaints by Amy Deady against Arachas Limited after finding the wrong legal entity had been named. Adjudication Officer Conor Stokes dated the decision 14 May 2026. The ruling did not decide whether any alleged breach of the Transfer of Undertakings Regulations occurred, and no award was recorded. Deady accepted that the incorrect entity had been named when she lodged the complaints, and the respondent’s representative also submitted that the wrong economic and legal entity had been named.
