WRC declines to hear race discrimination complaint against OCS

The Workplace Relations Commission declined jurisdiction over Shoaib Afghan’s race discrimination complaint against Ocs One Complete Solution Ltd, finding it was filed outside the six-month time limit. The decision was dated 31 August 2026. Afghan alleged a Tesco employee made a racial or religious slur in September 2024 and that OCS managers failed to support him after he reported it. OCS denied discrimination and argued the complaint was out of time. The adjudicator found the later November incident and termination were unrelated to the September allegation, and Afghan had not established reasonable cause for the delay. The complaint was not heard on its merits and no compensation was awarded.
