WRC rejects ABM worker’s constructive dismissal claim

The Workplace Relations Commission has rejected Darren O’Kane’s constructive dismissal complaint against ABM Ireland Limited, finding he was not unfairly dismissed. The decision was dated 2 September 2026. O’Kane alleged that his job had been filled while he was on sick leave and that no work was offered when he expected to return, leading him to resign. The adjudication officer accepted that he had been replaced and that a phone call was unprofessional, but found internal procedures remained available and further engagement had not been shown to be futile.
