The Workplace Relations Commission awarded Nicole Madariaga €16,243.31 after finding that Kishore Mygala Store Limited dismissed her because of a business transfer and failed to inform or consult her. The decision, dated 8 May 2026, ordered payment within 42 days.
Madariaga had worked as a deli assistant for Elpurkarova Retail Ltd. When the shop transferred to Kishore Mygala Store Limited in February 2025, she said she was told she would need to interview for a role and was not given a job to return to. The company said the deli had closed and an interview would explain possible work in another area.
The WRC awarded €14,984.87 for dismissal contrary to transfer protections and €1,258.44 for the failure to inform and consult. It rejected her separate constructive-dismissal complaint.
