The Workplace Relations Commission found that Valentina Neri’s complaint of gender discrimination and harassment over a work jacket was not well-founded. The decision was dated 26 February 2026, and no award was recorded. Neri said she felt obliged to wear a jacket she believed was part of a male uniform. Bc McGettigan Limited denied discrimination, saying uniform delays stemmed from stock and operational issues and that another jacket was available. The adjudicator accepted the supervisor’s evidence that Neri could decline the jacket and that an alternative was sought. The adjudicator found the difficulty arose from uniform availability rather than Neri’s gender identity. No gender-related remarks or conduct targeting her because she is transgender were established, and the decision said no comparator evidence showed more favourable treatment in similar circumstances. Neri did not pursue the sexual-orientation ground, so the decision addressed only the gender ground.
