The Workplace Relations Commission found that Multi-Color Labels Castlebar Ireland Limited discriminated against Sean Kenny on age grounds by retiring him at 65 without objectively justifying the retirement age. In a decision dated 22 June 2026, it ordered the company to pay him €5,000 compensation and to provide current and future employees with a written rationale for the contractual retirement age.

The company said the retirement age was in Kenny’s signed contract and relied on succession planning and business needs. The adjudication officer found the company had not established objective justification, noting that its rationale was not set out in writing in the contract, handbook or policy submitted to the WRC.
