WRC finds Anne Mullen lacked service for unfair dismissal claim

The Workplace Relations Commission found Anne Mullen’s unfair dismissal complaint against Mark O’Neill was not well-founded because she had only about 11 weeks’ service with him. The decision was dated 4 June 2026. Mullen argued that her service carried over from the previous operator, while O’Neill said she had only recently joined his business. The adjudicator found that Mullen had accepted redundancy from the previous employer and that no transfer of undertakings applied. The decision therefore turned on the continuous-service requirement and did not decide whether the dismissal was otherwise fair.
