The Workplace Relations Commission has rejected Marian Moran’s age discrimination complaint against St Vincent's Healthcare Group DAC over her pension entitlement. In a decision dated 1 September 2025, adjudication officer Catherine Byrne found Moran had not established facts supporting a presumption of discrimination.
Moran argued that a grade VII statistics manager job advertised after her retirement was the same role she had held at grade VI, and that her pension should reflect the higher grade. The Group said the new position had increased demands and disputed that it was comparable. The adjudicator found no evidence that a younger person received more favourable pension treatment and said the grade VII appointee was not a pensioner comparator. She concluded that pension entitlement was linked to salary at retirement and that later organisational changes did not create an entitlement to a higher pension.
